The Deputy County Attorney I is a position appointed by and under the supervision of the County Attorney. The Deputy County Attorney I position involves various legal duties and responsibilities as provided by statues and as prescribed by the County Attorney. Responsibilities include the preparation and prosecution of cases involving the violation of criminal, civil, or traffic law. Work is performed under the general direction of the County Attorney, but the employee has considerable latitude for independent judgment and initiative within established policies.
- Interviews and advises complainants and witnesses;
- Examines, evaluates and presents evidence;
- Prepares and prosecutes juvenile offense, Care & Treatment, Child in Need of Care, Traffic and Criminal cases, both misdemeanor and felony;
- Prepares opinions, briefs, pleadings and other legal documents
- Studies and analyzes writs, pleadings, exhibits, case files and records in order to ascertain the issues before the court and appropriate legal precedent;
- Appears before the Sumner County District Court on arraignments, evidentiary hearing, preliminary hearing, termination hearings, bench trials and jury trials;
- Prepares briefs and other motions for the Kansas Supreme Court and Kansas Court of Appeals;
- Appears before the Kansas Supreme Court and Kansas Court of Appeals;
- Prepares pleadings and appears on extraditions cases;
- Prepares pleadings and represents the State of Kansas on Habeas Corpus and other civil matters pertaining to criminal cases;
- Performs other duties as deemed necessary or assigned;
- Attends training seminars and classes as required by the County Attorney;

Experience: None required
Education: Applicants must have a Juris Doctorate degree from an accredited law school. Also, applicants must have a license to practice law in the State of Kansas and maintain license throughout employment.
Technical Skills:Ability to present statements of facts, law and arguments clearly and logically in written or oral form; effectively analyze and appraise legal problems and to apply legal principles and precedent to particular sets of facts, establish and maintain effective working relationships. Knowledge of the canons of professional ethics of the American Bar Association and the related provision of the Kansas State Bar, the principles and application of criminal and civil law; trial procedures and rules of evidence; legal and organizational skills. Ability to deal tactfully with other person and to communicate effectively and clearly, both orally and in writing. Proficiency in using computer software applications to include word processing, spreadsheet and databases.
Problem Solving: Extensive problem solving exists. Typical problems involve analyzing and appraising legal situations and then applying legal principles and precedent to the particular sets of facts to determine the most appropriate legal action to take.
Decision-Making: Extensive decision making required. Decisions relate to determining the most appropriate and effective legal action that should be taken in cases of the violation of criminal, civil, and/or traffic laws.
Supervision: Limited direct supervision provided related to daily job functions. Work performance may be reviewed for general procedures and effectiveness. Employee has limited supervisory responsibilities over subordinate personnel.
Financial Accountability: Employee is accountable for the proper recording and handling of any fees or valuables encountered in the performances of duties.
Personal Relations: Frequent contact with personal in all areas of the criminal justice system and frequent contact with the general public
Working Conditions:Adverse working conditions generally do not exist in this position. Work hours are generally 8:00 a.m. to 5:00 p.m. Unexpected work hours may be required due to emergency proceedings or scene investigations where the presence of the County Attorney’s Office is necessary.
Physical Requirements: To perform the duties of this job, the employee must have fine and gross manual dexterity. Specific vision abilities required by this position include close vision, color vision an depth perception. Ability to sit and stand for long periods of time. Ability to lift up to twenty-five (25) points; bend, stoop and kneel.
